Compensation for personal injury claims can be broken down into two types of damages: general and special damages.

General Damages
General damages are awarded to compensate for pain, suffering and loss of amenity. The amount of compensation will be determined by the severity of the injury, estimated recovery time and rehabilitation needed. Additionally, the amount awarded may be influenced by the need for further medical treatment or lifelong care.

Special Damages
On the other hand, special damages are awarded to cover specific expenses related to the injury. This can include medical fees, physiotherapy, loss of earnings, travel expenses to hospital, and damage to personal items. In more serious cases, special damages may also cover the costs of ongoing care, loss of future salary and pension, or adaptations to the home.

At Nash & Co Solicitors, we understand that every personal injury case is unique, and we work hard to ensure our clients receive the compensation they deserve. Our team of experienced personal injury lawyers will work with you to gather evidence, build a strong case, and negotiate a settlement that covers all your needs.

Frequently asked questions

We address the most commonly asked questions about personal injury claims and compensation. Whether you've been injured in a car accident, workplace incident, or any other unfortunate situation, this video playlist is here to provide you with the essential information you need.

  • If you've been in a road traffic accident that wasn't your fault and are looking to make a compensation claim, the first step is to seek medical attention for any injuries sustained. Once you're able to speak to someone, contact a lawyer who specialises in road traffic accidents, such as Nash & Co Solicitors.

During your initial consultation with one of our lawyers, they will discuss the details of your case and advise you on your options. They will explain the claims process and answer any questions you may have. If your case is eligible for compensation, we will require evidence to support your claim, including medical records and any other relevant documentation.

At Nash & Co Solicitors, we work with medical experts who can provide professional opinions on your injuries and any potential impact they may have on your life going forward. This information will be used to build a strong case for compensation.

Our team of experienced road traffic accident lawyers will handle all negotiations with the insurance company on your behalf, ensuring that you receive the compensation you are entitled to. We will keep you informed throughout the process and provide support and guidance every step of the way.

Don't hesitate to get in touch with Nash & Co Solicitors if you have been involved in a road traffic accident that wasn't your fault. We offer a free initial consultation and work on a no win no fee basis, so you don't have to worry about legal fees.

  • If you were able to gather evidence at the scene of the accident, we will ask you to provide that to us. This evidence may include:

The details of the vehicle that hit you, including the car registration number, colour and model of the vehicle. The details of the person responsible for the accident or the other driver

Information about any witnesses to the accident

Photographs of the accident scene and your injuries.

You may also be requested to provide information about any medical appointments you have attended and any medications you have been prescribed for your injuries. We will also arrange for an independent medical examination where a medical expert will evaluate your injuries and prepare a report based on their findings.

  • If you sustained injuries in a road traffic accident but were not wearing a seatbelt, you may still be able to make a compensation claim. However, if it is determined that not wearing a seatbelt contributed to the severity of your injuries, you may be deemed partially responsible for the accident. In such cases, your compensation payment will be reduced to reflect the percentage of your blame.

  • In the unfortunate event of an accident with an uninsured driver, you may still be able to claim compensation. Our road traffic accident team can represent you on a no win, no fee basis. The Motor Insurers Bureau (MIB) was established to ensure that victims who suffer personal injury and losses due to an uninsured driver can claim compensation.

Similar to an insurer, the MIB conducts investigations into the case by obtaining police reports, engineer reports, witness statements, and contacting the DVLA. Within six weeks, they aim to provide a response, but if they need more time, they have an additional three months to investigate and provide their comments. We’ll be right by your side throughout this process, helping you to make a successful claim.
